As a part of your transaction, you must read – and accept – the certification of intended use, which certifies that you have a legitimate need for this data and that you are entitled to the information under one or more permissible uses set forth in the Federal Drivers Privacy Protection Act (or DPPA), 18 USC 2721-2725, and North Carolina G.S. 20-43.1. This information will be logged for auditing purposes each time you conduct an online driving record search.
Certification of Intended Use
I certify under penalty of law that I am entitled to personal information from the requested motor vehicle record under one or more of the permissible uses listed in the federal Driver Privacy Protection Act.*
I am aware that there are federal criminal and civil penalties for knowingly obtaining, disclosing or using this personal information for a purpose not permitted under DPPA (18 U.S.C. Sections 2721-2724).
I also understand that North Carolina G.S. 20-43.1 prohibits someone from obtaining personal information from a driver record by purposely or knowingly misrepresenting his or her identity or the use for which he or she is seeking that information. Anyone who does so may be charged with felony tampering with a public record.
Disclosure of Personal Information
Personal information MAY be disclosed as follows:
- For the applicant's own personal record (Not applicable to Crash Reports without a DPPA Permissible Use)
Permissible Uses
CDL Verification (not applicable to Crash Reports)
For use by employers to verify information regarding Commercial Driver’s Licenses (CDLs).
Civil, Criminal, Administrative or Arbitral Proceedings
For use in connection with a proceeding that takes place in any federal, state, or local court or agency. Includes the service of process, investigations in anticipation of litigation and the execution of enforcement of judgments and court related orders.
Insurance
For use by any insurer or insurance support organization, or by a self-insured entity, or its agent’s employees, or contractors, in connection with claims investigation activities, antifraud activities, rating or underwriting.
Motor Vehicle Related (not applicable to online Crash Reports)
For use by an entity acting upon the behalf of a governmental business/individual or motor vehicle manufacturer for use in connection with matters of motor vehicle or driver safety and theft; motor vehicle emissions; motor vehicle product alterations, recalls or advisories; performance monitoring of motor vehicles, motor vehicle parts and dealers; motor vehicle market research activities, including survey research; and removal of non-owner records from the original owner records of motor vehicle manufacturers.
Private Tolling (Not applicable to Crash Reports)
In connection with private toll transportation facilities.
Research & Statistics (Not applicable to Crash Reports)
For research activities or statistical reports where personal information is NOT published, redisclosed, and/or used to contact individuals.
Towing or Impound
For use by towing companies and impound lots in providing notice to owners of PREVIOUSLY towed or impounded vehicles.
Verify Information Accuracy as Detailed Under the DPPA (Not applicable for Crash Reports)
For use in the normal course of business by a legitimate business or its agent, employees, or contractors, BUT ONLY:
A. To verify the accuracy of personal information PREVIOUSLY submitted by the individual to the business, its agents, employees, or contractor; AND
B. If such information as PREVIOUSLY submitted is not correct or is no longer correct, to obtain the correct information, BUT ONLY for the purposes of preventing fraud by, pursuing legal remedies against, or recovering on a debt or security interest against the individual.
